Terms of Service
These Terms of Service (“Terms”) govern your use of the website honeytreeearlylearningandkindergarten.online and any enrolment in, or engagement of, the early learning and kindergarten services provided by Honey Tree Early Learning and Kindergarten Pty Ltd (ABN 81 703 631 798) of Melbourne VIC, Australia (“we”, “us” or “our”). By enrolling a child, submitting an enquiry or using our website, you agree to these Terms. If you do not agree, please do not use the website or our services.
1. Interpretation
In these Terms, “parent” or “guardian” means a person with parental responsibility for a child enrolled with us, “enrolled child” means a child accepted into our programs, and “services” means our early learning, long day care and kindergarten programs, together with related information, enquiries and administrative support provided through our website or centre.
2. Enrolment and acceptance
- Enrolment is confirmed only when we accept a completed enrolment form and any requested documentation, including immunisation status and emergency contact details.
- Places are subject to availability, applicable staff-to-child ratios and our ability to meet the child’s needs.
- You agree to keep your contact details, authorised collectors and medical information up to date at all times.
3. Fees, payment and subsidies
- All fees are quoted in Australian dollars (AUD) and are set out in our current fee schedule provided before enrolment.
- Fees are payable in advance in accordance with the payment terms confirmed at enrolment. Late or unpaid fees may result in suspension or cancellation of a place.
- Where you are eligible for the Australian Government Child Care Subsidy, fees may be reduced by the subsidised amount, subject to approval by Services Australia.
- Where GST applies to any service, it is included in the advertised price.
4. Cancellation, withdrawal and refunds
- To withdraw an enrolled child, you must give written notice by email to ceo@honeytreeearlylearningandkindergarten.online with at least two (2) weeks’ notice, or such other notice period stated in your enrolment agreement.
- Fees paid for days on which care is not yet provided will be refunded or credited where we cancel a booking, or where withdrawal notice is given within the required period.
- Fees for days on which a place is held (including absence days) are payable in accordance with the enrolment agreement.
5. Health, safety and sign-in requirements
- Enrolled children must be signed in and out each day by an authorised parent or guardian, or by an adult listed as an authorised collector.
- You must advise us of allergies, medical conditions, anaphylaxis or asthma plans and any medication requirements before attendance begins.
- Children who are unwell with an infectious condition must be kept at home for the recommended exclusion period.
- We will notify you promptly of any incident, injury, illness or trauma involving your child, in line with the National Quality Framework.
6. Parent and guardian responsibilities
- You agree to provide accurate information on enrolment and to treat our educators, staff, other families and children with respect.
- You authorise us to seek emergency medical treatment for your child where reasonably required and you cannot be contacted, subject to any limitations recorded in the enrolment form.
- Photography and media consent is managed separately through the enrolment form and can be withdrawn at any time in writing.
7. Consumer guarantees (Australian Consumer Law)
Our services come with guarantees that cannot be excluded under the Australian Consumer Law, being Schedule 2 of the Competition and Consumer Act 2010 (Cth). For major failures with our services, you are entitled to cancel your enrolment and receive a refund for the unused portion of fees already paid, or compensation for the reduced value of the services. You are also entitled to have services remedied or resupplied where they fail to meet the required standard and the failure is not major. Nothing in these Terms excludes, restricts or modifies those guarantees or any other rights you have under Australian law.
8. Limitation of liability
To the fullest extent permitted by law, our liability for any breach of these Terms is limited, at our option, to resupplying the relevant service or paying the cost of resupply. We are not liable for indirect or consequential loss, except where such exclusion is not permitted by the Australian Consumer Law or other applicable legislation.
9. Website content and intellectual property
All text, graphics, logos and materials on this website are owned by or licensed to Honey Tree Early Learning and Kindergarten Pty Ltd and are protected by Australian copyright law. You may view and print pages for personal, non-commercial use only. Content is general in nature and does not constitute educational, medical or legal advice for your individual circumstances.
10. External links
Our website may contain links to third-party websites, including government resources. We do not endorse and are not responsible for the content or availability of those sites.
11. Privacy
We handle personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth) and Australian Privacy Principles.
12. Complaints and dispute resolution
- Complaints may be made in writing to ceo@honeytreeearlylearningandkindergarten.online. We will acknowledge your complaint and respond within a reasonable time.
- If a complaint is not resolved, you may contact the relevant Victorian regulatory authority for education and care services, or seek independent external dispute resolution.
13. Changes to these Terms
We may update these Terms from time to time. The current version will always be published on this page with a revised date. Continued use of the website or our services after an update constitutes acceptance of the revised Terms.
14. Governing law
These Terms are governed by the laws of Victoria, Australia, and the parties submit to the jurisdiction of the courts and tribunals of Victoria, Australia. Any provisions of the Australian Consumer Law that apply despite this clause remain unaffected.
